Terms of Service

These Terms of Service govern use of the CouncilUnit casework management platform ("the Service") by councillor users. CouncilUnit is a trading name of Civicunit Ltd, company number 17333404. Where a council or council group has a separate signed agreement with CouncilUnit governing their use of the Service (such as a Council Support Agreement or Councillor Support Agreement), the terms of that signed agreement take priority over these Terms in the event of any conflict. These Terms apply as the baseline terms of use for the platform itself and for any individual councillor's day-to-day use of it.

CouncilUnit provides software for councillors to log, track and respond to resident casework, including constituent record-keeping, case tracking, correspondence (email and letter generation), and related tools. Access is provided on a licensed basis to councils and individual councillors who have agreed pricing and terms separately with CouncilUnit.

Councillor accounts are created and issued by CouncilUnit on behalf of the relevant council or councillor client. You are responsible for keeping your login credentials secure and for all activity under your account. Notify us immediately at legal@councilunit.co.uk if you believe your account has been accessed without authorisation.

You agree to use the Service only for legitimate councillor casework and related political/community representation activity, and not to:

• Access or attempt to access data belonging to a council or councillor other than your own
• Use the Service to send unlawful, defamatory, or harassing communications
• Attempt to interfere with the security or normal operation of the Service
• Share your login credentials with anyone else

Use of the Service in connection with constituent personal data is governed by our Privacy Policy and, for council clients, a separate data processing agreement. You are responsible for ensuring you have a lawful basis to enter any personal data into the Service, and for complying with your own council's code of conduct and any applicable data protection obligations.

We aim to keep the Service available and operating reliably but do not guarantee uninterrupted availability, and the Service may be unavailable from time to time for maintenance or due to circumstances outside our control. Where a council or councillor has a signed agreement with CouncilUnit specifying service levels, those terms apply in addition to this section.

The Service, including its software, design, and underlying methods and templates, is owned by CouncilUnit/Civicunit Ltd. Councils and councillors are granted a licence to use the Service for their own casework purposes for the duration of their agreement with us, but do not acquire ownership of the underlying platform.

To the extent permitted by law, CouncilUnit's liability in connection with use of the Service is limited as set out in the relevant signed agreement between CouncilUnit and the council or councillor client. Where no such agreement specifies a liability cap, our total liability arising from use of the Service is limited to the fees paid for the Service in the 12 months preceding the event giving rise to the claim, except for liability that cannot be limited by law (such as death or personal injury caused by negligence, or fraud).

Access to the Service may be suspended or terminated in accordance with the terms of the relevant signed agreement between CouncilUnit and the council or councillor client, or, where no such agreement exists or in cases of misuse of the Service in breach of section 4, at CouncilUnit's reasonable discretion with notice where practicable.

We may update these Terms from time to time. We'll update the "last updated" date when we do, and for material changes, we'll take reasonable steps to notify councillor account holders.

These Terms are governed by the laws of England and Wales, and any dispute is subject to the exclusive jurisdiction of the courts of England and Wales.
